Intellectual property rights (IPRs) protection in organic agriculture and processed foods

Abstract

During COVID-19, the organic agriculture and allied food sector expanded rapidly. The consumer requires healthy, nutritious, and safe foods for daily life, which can be fulfilled through organic processed foods generated by organic agriculture. Many organic foods and beverages have been innovatively made and applied for IPR protection in previous years to reach and grab the world market. However, there are many hurdles toward protecting the technologies at different stages of processing. IPR protection starts from crop growing to postharvest intervention-packaging, designing, and marketing. Businesses should understand IPR protection and its limitations, as they are required for process and product protection worldwide. The overall protection of any product by IP is a typical approach that varies from nation to nation and product category to its valorizations. This chapter briefly discusses the overall IPR protection for organic agriculture and processed foods around the world in terms of plant breeders' rights, the Sui generis system, patents, geographical indication (GI), trademarks, design, trade secrets, copyright, and benefit-sharing under the Convention on Biodiversity (CBD). © 2023 Apple Academic Press, Inc.
